Protecting Asylum Seekers and Migrants in the Context of the Rule of Law Crisis in EU Member States: The Recent Approach of the Court of Justice of the EU through the Lens of the Global Compacts on Refugees and Migration

In recent times, the CJEU has started to develop its judicial response “rule of law crisis” in some Member States. On one hand, this new trend emerged also as a reaction national reforms concerning asylum and migration law. other protecting EU founding values deployed “traditional” competences attributed it by Treaties, namely mechanisms preliminary ruling procedure infringement procedure. Against background, contribution aims at investigating CJEU’s jurisprudence through lens Global Compacts on Refugees Migration. This will lead us reflect how caselaw could be seen an effective tool enhance rule protect third-country nationals, least within EU, indirectly contributes increasing compliance with commitments laid down Compacts, regardless position taken recalcitrant States respect these documents.
